Despite the general apathetic attitude to Terms & Conditions/Terms of Use/Terms of Service (we carried out simple social media polls results of which can be found on our Instagram highlights), the importance of these terms cannot be over-emphasized. Here are a few important reasons to read and use them whether you use or own a business/website/mobile application, or provide a service:
- It gives you a chance to clearly spell out the manner in which you would like users to engage with your content and other users. You can set rules, define what constitutes abuse, and take disciplinary actions against violators;
- It helps to limit liability for any errors by you or misunderstanding by the user, thus avoiding needless and time consuming complaints and lawsuits;
- It affords you the opportunity of stating your intellectual property rights and warning against breach;
- It enables you to communicate your awareness of relevant laws to your users/subscribers, and assure them of your compliance. (If you collect data, you will also need a privacy policy)
While most people do not read them, this will not exclude anyone who has accepted them from being bound. Ensure that you consult a lawyer for help in drafting as copying and pasting without adapting them to your business, especially in relation to the applicable laws could be dangerous.
